Help.. I’m trying to enrol my kids in school and my ex won’t agree…

With the end of the year fast approaching, schools are finalising their enrolments for 2026.  Do you have a child who is starting prep (or the equivalent in another state) next year? Or do you want to change your child’s school next year?

Except in limited circumstances (where there is an order giving one parent sole decision making ability), both parents are required to sign school enrolment forms.

If the other parent is refusing to sign school enrolment forms, you are going to have issues enrolling your child in school next year.

If it is the case that you and the other parent cannot agree on the school that your child is to attend, you may need to seek the assistance of the Court to have the Court make a decision.

The Court will consider all relevant circumstances of the school including where the child lives, the location of the school, payment of fees (if applicable) and other matters impacting the decision on where to enrol a child.

Prior to going to Court (except in limited circumstances) you will need to attend family dispute resolution with the other parent, to make a genuine attempt to resolve the dispute. You will need to demonstrate to the Court that you have made attempts to resolve the dispute (or that it was not appropriate to attend dispute resolution).

It is important to seek legal advice as soon as possible if you think you may need legal assistance in finalising your child’s school enrolment for next year.  The Court process takes time, and the end of the year is fast approaching.
